Chapter 7

Also sometimes called a "fresh start" bankruptcy, Chapter 7 is a process through which most or all of your unsecured debt can be discharged. By having your debt dismissed, you are able to begin debt-free along the road to financial recovery. Individuals considering Chapter 7 must pass the Means Test, which assesses their amount of disposable income and eligibility for Chapter 7.

Chapter 13

The Chapter 13 bankruptcy is a structured repayment plan that is geared toward allowing you to repay a percentage of your debt in order to regain control of the debt that has accumulated. Many individuals who do not qualify for Chapter 7 due to a surplus of disposable income will still qualify for Chapter 13.
